1. About these Terms

These Terms of Use ("Terms") govern your access to and use of ceritas.com and any related content, features and services (together, the "Site"), which is operated by CERITAS PTY LTD trading as Ceritas ("Ceritas", "we", "us" or "our").

By accessing or using the Site, subscribing to our newsletter, creating an account or purchasing products from us, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Site.

2. Eligibility

The Site is intended for users who are at least 18 years of age. By using the Site, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

3. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Changes take effect when posted. Your continued use of the Site after changes are posted means you accept the updated Terms. We encourage you to review these Terms periodically.

4. Important health disclaimer — no medical advice

The content on the Site, including articles, product analysis, laboratory results and the Ceritas Score, is provided for general information and educational purposes only. It is not medical, health, nutritional, dietary or other professional advice, and it is not a substitute for advice from a qualified healthcare professional.

You should always seek the advice of your doctor or another qualified health provider before making any decision about your health, diet, supplements or treatment, and before acting on anything you read on the Site. Never disregard professional medical advice, or delay seeking it, because of something you have read on the Site. Your use of the Site does not create a doctor–patient or any other professional relationship between you and Ceritas.

Any products, ingredients or statements discussed on the Site have not necessarily been assessed by the Therapeutic Goods Administration (TGA) and are not intended to diagnose, treat, cure or prevent any disease or health condition. If you think you may have a medical emergency, call your doctor or emergency services (000 in Australia) immediately.

5. Laboratory testing, results and the Ceritas Score

A core part of the Site is the publication of independent laboratory testing and a proprietary rating known as the "Ceritas Score". You acknowledge and agree that:

Results reflect specific samples at a point in time. Testing is carried out on individual units or batches of a product purchased at a particular time. Results may not reflect the current formulation, other batches, other units, or the product as it exists at the time you read about it. Formulations, ingredients, sourcing and manufacturing processes can change without notice.
Testing is performed by third parties. Laboratory analysis is conducted by independent third-party laboratories. While we report results in good faith and take care in presenting them, we do not warrant that they are accurate, complete or free from error, and we are not responsible for errors made by laboratories or testing methods.
The Ceritas Score is our opinion. The Ceritas Score is an editorial assessment based on our own methodology, criteria and weightings. It reflects our honest opinion and is not a statement of objective or absolute fact. Other people may reasonably weigh the same information differently or reach different conclusions.
No recommendation. Nothing on the Site is a recommendation, endorsement or instruction to buy, use, avoid or stop using any product. You are responsible for your own research and decisions.

Comparisons, rankings and scores are based on the information available to us at the time of publication and may not be updated as products or circumstances change.

6. Ceritas Premium subscription

Ceritas Premium is a paid subscription, currently AUD $3.99 per month including GST where applicable, that unlocks full access to laboratory results and testing information reserved for subscribers. Access is personal and non-transferable — don't share your login or redistribute subscriber content. You must be 18 or older, able to enter a contract, and hold a Ceritas account to subscribe.

Price and renewal. Payment is processed via Stripe; we don't store your card details. There is no free trial. The subscription is charged in advance and renews automatically each month on the same date (or the last day of shorter months) until cancelled.
Your locked-in price. You pay the price shown when you subscribe. Any future price increase applies only to new subscriptions and to subscriptions restarted after cancellation or lapse — while your subscription stays continuous, your price won't rise. If you resubscribe later, the then-current price applies.
Failed payments. If a payment fails, Stripe may retry it. If it remains unpaid within 7 days, your subscription and access may be suspended or cancelled; resubscribing later is at the then-current price.
Cancelling. Cancel any time via your account dashboard. This stops your next payment; access continues until the end of the period you've already paid for, then ends. There is no cancellation fee.
Refunds. We don't refund change-of-mind requests, part-used periods, or cancellations made before a period ends. This does not limit your rights under the Australian Consumer Law: our services come with consumer guarantees that cannot be excluded, and you may be entitled to a refund or other remedy for a major failure. To make a claim, contact us at info@ceritas.com.au.
Suspension. We may suspend or end your subscription for breach of these Terms — for example, sharing your login, attempting to scrape or bulk-download subscriber content, or unlawful use — giving notice where it's fair to do so.

Clause 5 above (Laboratory testing, results and the Ceritas Score) applies equally to content unlocked through Ceritas Premium.

7. Editorial independence and affiliate links

The Site does not yet contain affiliate links. The Site plans to contain affiliate links in the future, including through programs such as the Amazon Associates Program. If you click an affiliate link and make a purchase, we may earn a commission at no additional cost to you. Our affiliate relationships do not influence our testing, results, opinions or the Ceritas Score, and we do not accept payment from brands in exchange for favourable coverage. 8. Intellectual property

Unless otherwise stated, all content on the Site — including text, articles, methodology, the Ceritas Score and scoring system, graphics, logos, images, data compilations and the selection and arrangement of content — is owned by or licensed to Ceritas and is protected by copyright and other intellectual property laws.

You may view and access the content for your own personal, non-commercial use. You must not copy, reproduce, republish, distribute, scrape, data-mine, modify, sell or otherwise exploit any part of the Site or its content without our prior written permission, except as permitted by law (for example, fair dealing). You may share links to our articles.

9. Your account

If you create an account, you agree to provide accurate and current information and to keep it up to date. You are responsible for keeping your login details confidential and for all activity that occurs under your account. You must notify us promptly of any unauthorised use. We may suspend or terminate your account if you breach these Terms.

10. Acceptable use

You agree not to:

use the Site for any unlawful purpose or in breach of these Terms;
attempt to gain unauthorised access to the Site, its systems or other users' accounts;
introduce viruses, malware or other harmful code;
scrape, harvest, or use automated means to access or copy the Site or its content without our permission;
interfere with or disrupt the operation, security or integrity of the Site; or
use the content in a way that infringes our or any third party's rights.

11. Submissions and feedback

If you send us feedback, suggestions, ideas or other materials about the Site or our products, you agree that we may use them without restriction or obligation to you, and you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use, reproduce and adapt them for any purpose.

12. Third-party links and content

The Site contains links to third-party websites and resources, including affiliate links (planned future developement, not current) and references to external sources. We provide these for convenience and do not control, endorse or take responsibility for the content, products or practices of those websites. Accessing third-party websites is at your own risk and subject to their terms and policies.

13. Disclaimers

To the maximum extent permitted by law, the Site and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, error-free or secure, or that the content is accurate, complete, current or fit for any particular purpose. Any reliance you place on the content is at your own risk. This clause does not limit the health disclaimer in clause 4 or the disclaimers in clause 5, which also apply.

14. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the ACL or any other law that cannot lawfully be excluded, restricted or modified.

Subject to the above, to the maximum extent permitted by law:

we exclude all liability for any indirect, incidental, special or consequential loss, or loss of profits, data or goodwill, arising out of or in connection with your use of the Site; and
where our liability cannot be excluded but can be limited, our total liability to you is limited, at our option, to re-supplying the relevant goods or services or paying the cost of having them re-supplied.

You use the Site, and rely on its content, at your own risk.

15. Indemnity

You agree to indemnify and hold harmless Ceritas and its officers, employees and contractors from any claims, losses, liabilities, costs and expenses (including reasonable legal costs) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of any third party, except to the extent caused by our own negligence or wrongdoing.

16. Suspension and termination

We may suspend, restrict or terminate your access to the Site (including any account) at any time, without notice, if we reasonably believe you have breached these Terms or to protect the Site, our users or our rights. Clauses that by their nature should survive termination — including those relating to intellectual property, disclaimers, limitation of liability and indemnity — will continue to apply.

17. Governing law

These Terms are governed by the laws of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Australia and the courts able to hear appeals from them.

18. General

If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the rest will continue in force. Our failure to enforce any provision is not a waiver of it. You may not assign your rights under these Terms without our consent; we may assign ours. These Terms, together with our Privacy Policy, make up the entire agreement between you and us about your use of the Site.
